Should I go ahead and file for divorce before I hire you?

In most cases you should not. However, this is not ironclad. An attorney should

advise you on your particular situation. If you hire P. I. Ducks, Inc. while you are

still together, you will not alert your spouse to what is coming. In most cases, the

judge will find infidelity to be more of the cause of the divorce if it is proven while

you are still “supposed” to be married. Obviously, if you are being abused, you

should extricate yourself and your children as soon as possible.

Do you require a retainer prior to starting the investigation?

We do require a retainer on domestic cases. Although each case will stand alone,

the average retainer is $1,000. If you can only afford a lesser amount, the

investigation will be abbreviated accordingly. What if the investigation doesn’t

require the entire retainer? Once the investigation is concluded, a check will be

written to the client to cover the unused portion.

Should I hire an attorney prior to hiring P. I. Ducks, Inc.?

It is usually preferable to do so. We will then work through the attorney and will

be able to coordinate the amount of evidence he or she prefers. This is also

considered “Attorney Work Product” which is a little harder for the opposing

     counsel to get.

Is it illegal to put an automatic tape recorder on the phone?

Yes. If you are not a participant in the conversation, you cannot record it.

Can I record someone I am talking to without them knowing I am?

Yes. Whether you are talking to them face to face and you have a recorder in

your shirt pocket or you are on the phone with them, it is legal as long as you are

a party to the conversation. You can purchase tape recording devices for

telephones at various electronic stores for very reasonable prices.

Do you record sound while you are videotaping a subject?

No. Once again, it is illegal to record a conversation you are not a participant in.

In addition, it is very distracting to hear traffic sounds and other people talking

while trying to watch the video.

What kind of evidence is necessary to prove adultery?

Each attorney has different ideas concerning this subject. However, most will

agree, the tape should show the target spending the night with the opposite sex.

The investigator will need to stay all night and provide short periods of tape every

hour showing the subject still at the location. The investigator will show the

target coming out in the morning as well as having gone in the night before. He

will also be able to show who or how many others were at the location during that

     time.

If the target is committing adultery during the day, it is more difficult to prove.

However, if the evidence is compelling enough to the judge, such as prolonged

kissing, very intimate physical contact and visits of sufficient time to another

residence or motel, the case may be won. In these cases, it is imperative the

investigator work in conjunction with the attorney.
